Annual Administration

  • Determine employee eligibility for the plan
  • Determine and maintain vesting percentages
  • Calculate benefit and contribution amounts (including new comparability allocations)
  • Perform required testing under Internal Revenue Code sections as applicable:
  • perform ADP/ACP testing pursuant to IRS Code Sections 401(k) and 401(m) and related regulations
  • perform minimum coverage testing pursuant to IRS Code Section 410(b)
  • perform nondiscrimination testing pursuant to IRS Code Section 401(a)(4)
  • perform benefits, rights and features testing
  • perform minimum participation testing for defined benefit plans pursuant to IRS Code Section 401(a)(26)
  • perform compensation testing pursuant to IRS Code Section 414(s)
  • perform permitted disparity testing pursuant to IRS Code Section 401(l)
  • perform elective deferral limit testing pursuant to IRS Code Section 402(g)
  • perform benefit and contribution limits testing pursuant to IRS Code Section 415
  • perform top heavy testing pursuant to IRS Code Section 416
  • Prepare benefit and/or account statements on an accrual basis for participants
  • Prepare and/or reconcile trust activity
  • Prepare and process plan distributions for retirement, disability, termination, minimum required distributions, hardships and other permissible distributions
  • Determine available loan amounts and prepare loan documents
  • Reconcile contribution deposits and loan repayments
  • Furnish required information to auditors and offer audit support services
  • Analyze qualified domestic relations orders (QDROs) and process in accordance with IRS Code Section 414(p)
  • Determine forfeiture amounts and process in accordance with the plan document
  • Prepare signature-ready government forms and reports, as appropriate, including, but not limited to:
  • IRS Annual Returns/Reports such as: Form 5500, 5500 C/R, 5500 EZ
  • Attachments to Form 5500 series, which may include: Schedules A, B and attached actuarial report, C, F, G, H, P, T and/or SSA
  • Pension Benefit Guaranty Corporation PBGC Form 1
  • Form 1099-R
  • Form 5330
  • Forms 945, 990 and 990T
  • Prepare summary annual report (SAR)

Installation and Document Issues

  • Prepare and utilize Cache's standardized and non-standardized prototypes, volume submitter and individually designed plans
  • Prepare documents and amendments for review by plan sponsors and their legal counsel
  • Prepare summary plan descriptions (SPDs) and summaries of material modification (SMMs)
  • Prepare and submit favorable determination letter requests with the IRS
  • Establish initial participant recordkeeping accounts based upon employee census data furnished by plan sponsor

Takeover of Existing Plans

  • Review prior year’s administration and analyze plan for operational compliance
  • Review plan document and discuss pertinent plan design issues
  • Establish participant recordkeeping accounts on our system and assume ministerial responsibility in a timely manner
  • Assist investment provider (as necessary) with transfer of funds

Plan Terminations

  • Prepare plan document for plan termination
  • Communicate with the IRS and the PBGC, providing additional information as required, in the behalf of plan sponsors
  • Calculate the benefits payable to participants as a result of the termination of the plan and prepare distribution forms
  • Prepare submissions to the IRS and/or PBGC as required or requested
  • Prepare the final Annual Report/Return (Form 5500) for execution by plan sponsor

General Consulting

Address additional issues not listed above which may include, but are not limited to:

  • Revise plan documents to accommodate new client objectives or changes in law
  • Prepare excise tax returns
  • Prepare FASB ‘87 or ‘88 reports for plan sponsor financial statements
  • Perform control group and affiliated service group analyses
  • Represent the plan or plan sponsor in addition to items identified above
  • Advise plan sponsors on compliance with Federal Statutes and with Department of Treasury rulemaking and technical advice with respect to qualified plans
  • Assist in qualified plan compliance issues related to business mergers and acquisitions
  • Advise plan sponsors regarding the effect of new legislation or rulemaking
  • Prepare projected nondiscrimination tests as requested by the plan sponsor
